Welcome to SeniorPath.org (“SeniorPath,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, content, and services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1) Eligibility & Accounts
- Eligibility. You must be at least 18 years old (or the age of majority in your jurisdiction).
- Account Info. Provide accurate information and keep it updated. You’re responsible for activity on your account.
2) Acceptable Use
You agree not to misuse the Services, interfere with operation or security, reverse-engineer, decompile, or use the Services to violate laws or third-party rights.
3) Your Submissions & License
If you submit content or information to us (“User Content”), you grant SeniorPath a worldwide, nonexclusive, transferable, sublicensable, royalty-free license to use, host, reproduce, modify, distribute, and display it to operate and improve the Services and our business, including with partners and advertising networks, subject to our Privacy Policy.
You represent you have all rights necessary and your User Content does not infringe any rights or laws.
4) Referrals, Partners, and Third-Party Links
We may present, match, or refer you to third-party providers and resources. We do not control or endorse third-party offerings and are not responsible for their content, terms, or privacy practices. Use third-party services at your own risk and review their terms and policies.
5) Communications Consent
By providing contact information, you consent to receive communications from us and from partners we share or sell your data to, including calls, emails, texts, and prerecorded messages, even if your number is on a “Do Not Call” registry, to the extent permitted by law. Message/data rates may apply. You can opt out as described in our Privacy Policy or in the message itself.
6) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT GUARANTEE RESULTS, AVAILABILITY, OR THAT MATCHES/REFERRALS WILL MEET YOUR NEEDS.
7) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENIORPATH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF: (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $1,000.
Some jurisdictions do not allow certain limitations; some of the above may not apply to you.
8) Indemnification
You agree to defend, indemnify, and hold harmless SeniorPath from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or violation of these Terms.
9) Dispute Resolution; Arbitration; Class Waiver
Binding Arbitration. Any dispute arising out of or relating to the Services or these Terms shall be resolved by confidential, binding arbitration, rather than in court, except small-claims matters.
Class Waiver. You and we waive the right to participate in class or representative actions.
Opt-Out. You may opt out within 30 days of first accepting these Terms by emailing
jake@seniorpath.org with subject “Arbitration Opt-Out,” including your name, the email tied to your account, and a statement opting out.
Governing Law/Venue. These Terms are governed by the laws of the State of California (without regard to conflicts rules). If arbitration is inapplicable, exclusive venue shall be state or federal courts in San Diego County, California.
10) Termination
We may suspend or terminate access at any time for any reason. Sections intended to survive (e.g., licenses, disclaimers, limitation of liability, indemnity, dispute resolution) will survive termination.
11) Changes to the Services or Terms
We may modify the Services and update these Terms. We’ll post updates with a new “Last Updated” date. Continued use after changes means you accept the updated Terms.
12) Miscellaneous
- Entire Agreement. These Terms and the Privacy Policy are the entire agreement.
- Severability. If any provision is invalid, the rest remains in effect.
- Assignment. You may not assign these Terms; we may.
- No Waiver. Failure to enforce is not a waiver.
